Terms of Service

These Terms of Service ("Terms") govern your access to and use of Heptism's website at heptism.com and all associated services (collectively, the "Services"). By creating an account or using any part of the Services, you agree to be bound by these Terms.
If you're accepting these Terms on behalf of a company or other legal entity, you represent that you have authority to bind that entity. If you don't have that authority, do not use the Services.
1. Services
Heptism provides subscription-based consulting, marketing, automation, design, and development services. The specific services available depend on your chosen subscription plan (Starter, Growth, Scale, or Enterprise). Plan features, request limits, and included service categories are described on our pricing page.
We reserve the right to modify, expand, or discontinue any feature of the Services at any time, with reasonable notice to active subscribers for material changes.
2. Account registration
- You must provide accurate and complete information when creating an account
- You are responsible for keeping your login credentials secure and for all activity under your account
- You must promptly notify us of any unauthorised access at hello@heptism.com
- One account per individual or legal entity — no sharing accounts across separate organisations
3. Subscriptions and billing
All plans are billed monthly in advance. Prices are shown on our pricing page and confirmed at checkout.
- Upgrades take effect immediately. Your new plan replaces your current one — you won't be charged twice.
- Downgrades take effect at the next billing cycle unless you request immediate change.
- Pausing suspends service delivery and billing for up to 3 months. Active projects are placed on hold and resumed exactly where they left off.
- Cancellations must be made through your billing portal before your next renewal date. You retain access to the Services until the end of your current billing period. No refunds are issued for unused time in the current period.
Payments are processed by PayU or PayPal. By subscribing, you authorise recurring charges to your chosen payment method. We are not responsible for failures caused by payment processor outages.
4. Intellectual property and ownership
All work product created by Heptism exclusively for your engagement — including designs, code, copy, and strategy documents — is owned by you upon full payment. We retain no licence to use your work product after an engagement ends.
We may use your company name, logo, and general project description in our portfolio and marketing materials unless you request otherwise in writing before the engagement begins.
Heptism's own brand assets, proprietary methodologies, templates (in their original, unmodified form), and internal tooling remain our intellectual property.
5. Confidentiality
We treat all client information as confidential by default. We will not disclose your business information, project details, or proprietary data to third parties without your consent, except as required by law or to deliver the Services (e.g., sharing a brief with a specialist contractor under NDA).
On request, we'll execute a mutual NDA before the engagement begins.
6. Acceptable use
You agree not to use the Services to:
- Engage in any unlawful activity or violate applicable laws or regulations
- Infringe third-party intellectual property rights
- Create, distribute, or promote harmful, deceptive, or malicious content
- Attempt to gain unauthorised access to our systems or other users' accounts
- Resell or sublicense the Services without our written consent
We reserve the right to suspend or terminate accounts that violate this section, without refund.
7. Limitation of liability
To the maximum extent permitted by law, Heptism's total liability to you for any claim arising from or related to these Terms or the Services is limited to the amount you paid us in the 3 months preceding the claim.
We are not liable for indirect, incidental, special, consequential, or punitive damages — including lost profits, loss of data, or business interruption — even if advised of the possibility of such damages.
8. Warranties and disclaimers
We provide the Services on a professional best-efforts basis. The Services are provided "as is" without warranty of any kind beyond what's expressly stated in these Terms. We don't guarantee any specific business outcomes, revenue growth, or search engine rankings as a result of our work.
9. Governing law and disputes
These Terms are governed by the laws of India. Any dispute arising from or related to these Terms shall first be attempted to be resolved through good-faith negotiation. If that fails, disputes shall be submitted to binding arbitration under the rules of the Indian Arbitration and Conciliation Act, 1996.
10. Changes to these Terms
We may update these Terms from time to time. We'll post changes on this page and update the "last updated" date. For material changes, we'll notify active subscribers by email with at least 14 days' notice. Continued use of the Services after the effective date constitutes acceptance of the revised Terms.
